Terms of Service

These Terms of Service govern your access to and use of OrderMeAPlate.food. By creating an account, browsing listings, making a donation, uploading content, communicating through the platform, or otherwise using the site, you agree to be bound by these terms and by our related policies and guidelines.

1. Platform role

OrderMeAPlate.food is a marketing, listing, discovery, and community support platform. It is not a food seller, restaurant, caterer, manufacturer, distributor, delivery company, or food handler. The platform provides tools that allow independent vendors to create profiles, publish listings, share videos, communicate with supporters, and manage donation-based interactions. Any food or beverage referenced on the platform is offered by an independent vendor, not by OrderMeAPlate.food.

2. Donation model

All food, beverages, and related items presented by vendors on OrderMeAPlate.food are described as complimentary thank-you gifts offered in connection with voluntary donations made by supporters to the vendor. Suggested donation amounts are set by the vendor. OrderMeAPlate.food does not guarantee that any donation creates a retail sale, and the platform does not represent that it is selling food directly to buyers.

3. Independent vendors

Each vendor is an independent creator and is solely responsible for their own listings, descriptions, ingredients, labeling, preparation methods, storage practices, packaging, pickup arrangements, delivery arrangements, sanitation, permits, licenses, tax obligations, and legal compliance. No vendor is an employee, agent, partner, joint venturer, or representative of OrderMeAPlate.food. The platform does not supervise or control how vendors prepare, store, transport, or provide food.

4. Buyer assumption of risk and liability waiver

By using the platform, making a donation, arranging pickup or delivery, or accepting any complimentary food or beverage item from a vendor, buyers acknowledge and accept all risks associated with homemade and independently prepared food. These risks may include, without limitation, allergic reactions, ingredient cross-contact, contamination, spoilage, improper temperature control, unsafe packaging, unsafe transport, foodborne illness, injury, property damage, and other known or unknown harms. Buyers voluntarily assume all such risks and waive, release, and discharge OrderMeAPlate.food and its owners, operators, affiliates, and service providers from any and all claims, liabilities, damages, losses, costs, and expenses arising out of or related to food safety, preparation, storage, handling, packaging, delivery, allergic reactions, illness, injury, death, or other damages connected to vendor-provided items.

5. No responsibility for food-related issues

OrderMeAPlate.food is not responsible for and expressly disclaims liability for any vendor conduct or any food-related issue, including but not limited to ingredient accuracy, labeling errors, allergen disclosures, food preparation, kitchen conditions, sanitation, storage, refrigeration, transport, delivery timing, product quality, spoilage, contamination, illness, allergic reactions, or damages of any kind. Buyers are responsible for reviewing vendor information, asking questions, and deciding whether to support a vendor or accept a complimentary item.

6. Vendor compliance and cottage food laws

Vendors must comply with all applicable laws, regulations, ordinances, and licensing requirements in the jurisdictions where they operate, including cottage food laws where applicable. Vendors are responsible for determining whether their products may legally be prepared, marketed, donated, delivered, or distributed in their state or locality. OrderMeAPlate.food does not provide legal advice and does not guarantee that any listing or vendor activity complies with local, state, or federal law.

7. Accounts and eligibility

Users must provide accurate, current, and complete information when creating or maintaining an account. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. We may suspend, restrict, or terminate accounts that contain false information, are used unlawfully, or violate these terms or community standards.

8. Community conduct rules

All users must interact respectfully and lawfully. You may not post false, deceptive, defamatory, abusive, discriminatory, threatening, obscene, infringing, or otherwise harmful content. You may not misrepresent ingredients, health claims, sourcing, licensing, availability, or donation terms. Harassment, spam, fraud, manipulation of reviews, unsafe conduct, and attempts to move users into unlawful transactions are prohibited. We may remove content or restrict access where we believe conduct undermines trust, safety, or platform integrity.

9. Video transparency expectations

Because transparency is central to the platform, vendors are expected to present videos and visual content honestly and in good faith. Videos, photos, and descriptions should fairly represent the creator, the food, ingredients, preparation environment, packaging, and fulfillment practices. Vendors must not use deceptive edits, false demonstrations, misleading claims, or content that creates a false impression of safety, quality, licensing, or product availability. OrderMeAPlate.food may remove content that is misleading, unsafe, or inconsistent with platform expectations.

10. Donations and refund policy

Donations made through the platform are generally voluntary and final. Because vendors provide complimentary thank-you gifts in connection with donations, refunds are not guaranteed. Any refund, replacement, or other resolution is subject to the vendor’s stated terms, applicable law, and any platform policy then in effect. OrderMeAPlate.food reserves the right, but not the obligation, to review disputes and issue or deny refunds, credits, reversals, or account adjustments in its sole discretion where fraud, misuse, duplicate charges, or exceptional circumstances are identified.

11. Mediation and dispute resolution

Any dispute, claim, or controversy arising between a buyer and a vendor must first be submitted to mandatory mediation in the vendor’s state before any court action is filed, except where prohibited by law. Each party is responsible for its own costs unless otherwise required by applicable law or agreed in mediation. OrderMeAPlate.food is not obligated to participate in disputes between buyers and vendors, but may choose to assist with communications or records at its discretion.

12. No warranties and no guarantees

The platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, OrderMeAPlate.food disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, safety, availability, or reliability. We make no guarantees regarding vendor quality, food safety, legal compliance, donation outcomes, buyer satisfaction, uninterrupted access, platform performance, or the accuracy of user-generated content.

13. Intellectual property

All platform branding, site design, text, graphics, logos, software, and other platform-owned content are the property of OrderMeAPlate.food or its licensors and may not be copied, reproduced, distributed, modified, or exploited without permission. Users retain rights in content they submit to the extent they own it, but by posting content on the platform, you grant OrderMeAPlate.food a non-exclusive, worldwide, royalty-free license to host, display, reproduce, adapt, distribute, and promote that content in connection with operating, marketing, and improving the platform. You may not upload content that infringes another party’s intellectual property rights.

14. Privacy and data handling summary

By using the platform, you understand that OrderMeAPlate.food may collect and process account information, profile details, messages, donation records, uploaded videos, images, reviews, support requests, device data, and usage information in order to operate the site, provide features, improve services, support safety efforts, and comply with legal obligations. 15. Account suspension and termination

We may suspend, limit, remove, or terminate any account, listing, video, review, message, or other content at any time, with or without notice, if we believe a user has violated these terms, created safety concerns, engaged in fraud, posted misleading content, infringed intellectual property, failed to comply with applicable law, or otherwise exposed the platform or its users to risk. Users may also stop using the platform at any time, but obligations and waivers that by their nature should survive termination will remain in effect.

16. Changes to these terms

We may revise these Terms of Service from time to time. Updated terms become effective when posted on this page unless a different effective date is stated. Your continued use of OrderMeAPlate.food after updated terms are posted constitutes your acceptance of the revised terms to the extent permitted by law.
